FCC Should Reform and Strengthen Spectrum Screen

Washington, DC – Today, in reply comments filed with the Federal Communications Commission (FCC or Commission), CCA urged the Commission to reform the spectrum screen and implement a new, nationwide screen that effectively prevents excessive concentration of spectrum holdings.  In particular, CCA recommended adopting a separate screen for local spectrum holdings below 1 GHz; a clear and predictable mechanism for adding or removing spectrum from the analysis; and a heightened level of scrutiny for transactions exceeding any applicable screen threshold.

In a statement, CCA President & CEO Steven K. Berry said, “The decade-old, single-trigger spectrum screen is in dire need of reform, and numerous industry stakeholders have put forth proposals similar to CCA’s proposal which calls for prompt reform.  Not surprisingly, the industry’s two largest carriers – AT&T and Verizon – continue to urge the Commission to keep applying its broken spectrum screen, through which they have been able to continue an anti-competitive practice of warehousing vast amounts of spectrum.  Spectrum is a limited, taxpayer-owned resource, necessary for wireless growth, and the FCC must ensure all carriers have an opportunity to access additional mobile spectrum.”

Berry continued, “To promote investment and competition in the industry and benefit consumers, the Commission must strengthen its competitive review of transactions exceeding the screen.  Industry stakeholders overwhelmingly support the need to reform and strengthen the current screen and to reject the Twin Bells opposition for reform.  Competitive carriers must have access to usable spectrum, and I look forward to our continued work with the FCC on this issue.”
